OVERVIEW
This website is operated by Mindset Hypnotherapy. Throughout the site, the terms “we”, “us” and “our” refer to Mindset Hypnotherapy. Mindset Hypnotherapy offers this website including all information, tools and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here.
By visiting our site and/or purchasing a Treatment Programme or Treatment Programmes from us, you engage in our “Service” and are accepting and consenting to the practices described in these Terms and Conditions.
Please read these Terms and Conditions carefully before accessing or using our website. By accessing or using any part of the site, you agree to be bound by these Terms and Conditions. We reserve the right to modify these Terms and Conditions from time to time so please check back regularly. If you do not agree with any of these Terms and Conditions then you may not access the website or use any services. Also, please refer to our Privacy Statement also posted on our website.
SECTION ONE: ELIGIBILITY TO PURCHASE SERVICES
Please note that Mindset Hypnotherapy trades under New Zealand law.
In order to make a booking through the Site, you will be requested to register and provide your personal details. In particular, you (‘the Client) must provide your real name, e-mail address and other requested information as indicated. Please note: this information is used to help us to assist you when implementing your Treatment Programme. Please refer to our Privacy Statement for more information. Furthermore, when booking, you will be required to provide payment details and you agree to provide valid and accurate payment.
SECTION TWO: BOOKINGS POLICY
All bookings are subject to acceptance and availability. Please be aware of our cancellation policy.
Once you have chosen your Treatment Programme and your booking has been placed, you will receive an email linking you to your first Zoom session, and another email that links you to the payment page. Please note that the Zoom session can only proceed if payment is made at least three days prior to the date of the first Zoom session.
You must be 18 or over to be accepted onto our Treatment Programmes.
Please note: Your Hypnotherapy Consultant will be allocated to you based on availability for each Zoom session you book in your Treatment Programme. It is possible that you could work with both Hypnotherapy Consultants during the duration of your Treatment Programme.
SECTION THREE: PAYMENT POLICY
All prices quoted on our website are in New Zealand dollars (NZD), inclusive of GST, and payment is charged in New Zealand dollars.
Payment is made via credit card, securely, on Stripe.
There are two payment options you can choose from: Either make a complete payment for the Treatment Programme (receiving 10% discount off full price) prior to your first Zoom session (which signals the commencement of the Treatment Programme) or choose the split payment option, so that you pay 50% of the price prior to your first Zoom session (which signals the commencement of the Treatment Programme) and the other 50% prior to your third Zoom session (note that split payment option does not include the 10% discount).
Also, we will endeavour to take all reasonable care in keeping details of your booking and of your payment secure, however, we cannot be held liable for any loss suffered if an unauthorised third party accesses any information or data you have provided when accessing the site or in the process of booking via the site.
SECTION FOUR: RESCHEDULING & CANCELLATION POLICY
Rescheduling can be done by the Client at any time prior to any booked Zoom session – however, more than two reschedules by the Client, prior to their first Zoom session, results in termination of their Treatment Programme and refund of 50% of payment made.
Continued rescheduling (throughout the duration of the Treatment Programme) without more than 24 hours notice could be subject to Termination of your Treatment Programme (refer to our Termination Policy).
- Bookings cancelled more than three days prior to first Zoom session – 100% refund.
- Bookings cancelled between three days and 24 hours before first Zoom session – 80% refund.
- Bookings cancelled within 24 hours of first Zoom session – 50% refund.
- ‘No-show’ to first Zoom session (not rescheduled or cancelled) – 50% refund.
- For split payment options, if second / final payment (50% of price) has not been paid prior to third Zoom session, then Treatment Programme is suspended until second / final payment has been paid – this situation might affect Treatment Programme duration (see below regarding Treatment Programme Duration policy).
- There are no refunds that can be requested by the client once Treatment Programme has commenced (which is signalled by the attendance of the first Zoom session) – although there are provisions for extension of Treatment Programmes (see below Treatment Programme Duration policy).
- For any refunds: expect to wait up to two weeks for return of monies (with longer time periods possible and subject to variables outside our control due to use of third-party).
SECTION FIVE: TREATMENT PROGRAMME DURATION POLICY
We offer seven Treatment Programmes. Three of these Treatment Programmes (Stop Smoking, Stress Buster, Confidence Booster) are four week programmes, and four (Habit Elimination, Conquer Fear, Total Sleep, Anti Anxiety) are six week programmes.
These programmes are designed to be completed in the advertised time-frames (as per website) – the commencement of the duration of the programme is signalled by the attendance of the first Zoom session.
We reserve the right to extend the duration of our Treatment Programmes for any reason. Also, we allow for the extension of Treatment Programme due to client circumstances (such as due to illness and/or scheduling issues) – these extensions are applied based on communication from the client as to the reason they are asking for the extension. Extensions, for any reasons, cannot be extended beyond ten weeks (for the four week programmes) or beyond fourteen weeks) for the six week programmes. Termination of Treatment Programme is considered to apply a week following the fifth Zoom session, or at the end of four weeks / six weeks (depending on Treatment Programme) unless there has been an extension of duration which is done in writing and has the completion / termination date stated.
SECTION SIX: TERMINATION POLICY
During a First Zoom Session, we assess the appropriateness of the Treatment Programme booked by the Client and their suitability to be accepted on this programme. If we deem that the Client’s chosen Treatment Programme is not appropriate for them, then we reserve the right to either offer the Client transfer to another Treatment Programme (this might incur extra charge if the Treatment Programme being offered is more expensive than the original booked programme), or, to decide not to offer any other alternative programmes – in effect, not accepting the Client to continue with any Treatment Programmes, which means termination of our work together. If we decide to terminate our service, based on the first session assessment, the Client would receive a full refund. If the Client is offered an alternative Treatment Programme and declines the offer we would refund 80% of all monies paid.
Throughout the duration of your Treatment Programme, if at any time we assess that the treatment programme is no longer appropriate for you (‘the Client’), we reserve the right to terminate the Treatment Programme, and if we decide to do this you will be notified in writing with all monies paid by you to be fully refunded – the only exception to this is when the decision to terminate is based on lack of appropriate implementation of treatment programme components, and in this situation, a pro rata refund would be applied.
SECTION SEVEN: TREATMENT PROGRAMMES LIABILITY WAIVER
When you purchase a Treatment Programme you agree that this is done on the understanding and acknowledgement that we do not guarantee the success of any Treatment Programme and cannot be held liable for any outcomes of the Treatment Programme or for any aspects during the duration of the Treatment Programme – and in particular where you (‘the Client’) have not followed the treatment programme as instructed.
Attendance of the first Zoom session is an acknowledgment and acceptance of these Terms and Conditions including that you (‘the client’) has assumed all risks and released us of any liability.
Please note: individual results may vary. Success of our Treatment Programmes are contingent on many variables outside of our control, including and not limited to: undisclosed information that may be relevant to acceptance and/or continuation of the Treatment Programme/s, your appropriate application and implementation of the Treatment Programme/s, your personal environmental factors (both internal and external), and other such considerations.
We reserve the right to alter the content of your Treatment Programme if we deem this in your best interests for you as an individual and/or your individual circumstances. We may not inform you if we make any such ‘tweaks’ to your Treatment Programme.
SECTION EIGHT: INTELLECTUAL PROPERTIES RIGHTS
By accessing this site, you acknowledge and agree that all Content, including intellectual property and the website design pertaining to Mindset Hypnotherapy, remains at all times the property of Mindset Hypnotherapy and its respective owners. You are permitted to use the Content only as directed and expressly authorised by the owners of Mindset Hypnotherapy (directors of NZ School of Clinical Hypnotherapy) for the purposes of exploring the website and/or for the purposes of choosing, booking, and partaking in the Treatment Programme/s paid for. It is prohibited to reproduce or redistribute any Content from the Mindset Hypnotherapy website (or of its parent company NZ School of Clinical Hypnotherapy) or of any of its Treatment Programmes / Educational Programmes – specifically their Content or structure in whole or in part.
SECTION NINE: ACCURACY OF INFORMATION
Mindset Hypnotherapy supplies information on this site to assist the Client to choose the Treatment Programme most appropriate for them. While Mindset Hypnotherapy does try to ensure that all Content is accurate and reliable, we cannot be held liable for errors or omissions. Users of this site, and those that book a Treatment Programme/s, acknowledge that they do so at their own risk.
SECTION TEN: - DISCLAIMER OF WARRANTIES; LIMITATION OF LIABILITY
Mindset Hypnotherapy, its owners, and affiliates, make no warranties, expressed or implied, or guarantees or conditions regarding the use of our service/s. We provide our service/s on an “as is” and “as available” basis. We do not guarantee/warrant that your use of our service/s will be uninterrupted, timely, secure or error-free. We do not guarantee/warrant that the results that may be obtained from the use of our service/s will be accurate or reliable. Mindset Hypnotherapy, its owners, and affiliates, makes no representations or warranties of any kind that the Mindset Hypnotherapy website, or other third-party websites, or emails sent from Mindset Hypnotherapy or any included material or links are free of malware or other harmful components. You expressly agree that your use of, or inability to use, our service/s is at your sole risk. In no circumstances shall Mindset Hypnotherapy, its owners, or affiliates be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special or consequential damages of any kind. In no event, and under no circumstances will Mindset Hypnotherapy, its owners, or affiliates, be liable for any damages (even if Mindset Hypnotherapy has been advised of the possibility of such damages), and the maximum liability Mindset Hypnotherapy shall be limited to refund to the Client is the price paid by the Client for the Treatment Programme. All of our service/s are supplied with the best of intentions and in good faith.
